  • Terms and Conditions

    1. The Promoter
    1.1 The promoters are: English Heritage of The Engine House, Fire Fly Avenue, Swindon SN2 2EH, and Marks & Spencer’s [Marks and Spencer plc, Waterside House, 35 North Wharf Road, London, W2 1NW].

    2. The Prize Draw
    2.1 The title of the prize draw Win one of 20 annual memberships to English Heritage.

    3. How to enter
    3.1 The prize draw will run from 00:01am on 3 November 2023 to 11:59pm on 16 November inclusive.
    3.2 All prize draw entries must be received by English Heritage by no later than 11:59pm on 16 November 2023. All prize draw entries received after this time are automatically disqualified.
    3.3 To enter the prize draw:
    enter the prize draw online by completing the online entry form provided.
    3.4 English Heritage will not accept:
    (a) responsibility for prize draw entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    (b) proof of posting or transmission as proof of receipt of entry to the prize draw.
    3.5 By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions.
    3.6 The prize draw winner will be selected at random by English Heritage. The decision of English Heritage acting reasonably will be final.

    4. Eligibility
    4.1 The prize draw is only open to all M&S Sparks customers and employees who are resident in the UK aged 18 years or over, except: employees and households of English Heritage.

    4.2 In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize. English Heritage may require you to provide proof that you are eligible to enter the prize draw.
    4.3 English Heritage will not accept prize draw entries that are:
    (a) illegible, have been altered, reconstructed, forged or tampered with; or
    (b) incomplete.
    4.4 There is a limit of one entry per person.
    4.5 English Heritage reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

    5. The Prize
    5.1 20 winners will receive one Annual English Heritage Family Memberships (2 adults and 6 accompanying children per adult Member, under 18 and within the family group).
    5.2 Competition prize is not transferable and cannot be exchanged for cash or otherwise.
    5.3 Winners will be sent their prize to the address provided by them in their entry.
    5.4 Use of the prize will be subject to the terms and conditions of membership set out by English Heritage, full details of which can be found at https://www.english-heritage.org.uk

    6. Winner Announcement
    6.1 English Heritage will contact the winners personally within 7 business days of the close of the promotion, using the email addresses provided with the prize draw entry.
    6.2 The decision of English Heritage is final and no correspondence or discussion will be entered into.
    6.3 English Heritage will make all reasonable efforts to contact the winners. If the winners cannot be contacted or are not available within seven days, English Heritage reserves the right to offer the prizes to the next eligible entrants selected from the entries that were received before 16 November 2023.
    6.4 English Heritage does not accept any responsibility if you are not able to take up the prize.

    7. Limitation of Liability
    7.1 Insofar as is permitted by law, English Heritage, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of English Heritage, its agents or distributors or that of their employees. Your statutory rights are not affected.

    8. Ownership of Prize Draw Entries and Intellectual Property Rights
    8.1 English Heritage does not claim any rights of ownership in your competition/prize draw entry.

    9. Data and Publicity
    9.1 By entering the prize draw, you agree that any personal information provided by you with the prize draw entry may be held and used only by English Heritage or its agents and suppliers to administer the prize draw.

    10. General
    10.1 If there is any reason to believe that there has been a breach of these terms and conditions, English Heritage may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    10.2 English Heritage reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.
    10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
