TERMS AND CONDITIONS

Dracula Promo Competition Saturday 3rd and Sunday 4th August 2019

For a chance to win one year’s (Annual) Membership to English Heritage, follow us on Facebook or Twitter and share your images with our 3D Bat Artwork in Whitby Town. For details of how to enter, and terms and conditions see below.

1. THE PROMOTER

1.1. The promoter is: English Heritage of The Engine House, Fire Fly Avenue, Swindon SN2 2EH

2. THE COMPETITION

2.1. The title of the competition is Bats of Dracula Competition

3. DEADLINE FOR ENTRIES

3.1. Entries must be received between 08:00 BST on Saturday 3rd August 2019 and 23:59 BST on Sunday 4th August 2019 (the “Closing Date”). Entries received after the Closing Date will not be accepted.

4. HOW TO ENTER

4.1. There are two Social Media platforms on which to enter, (a) Facebook or (b) Twitter, see below instructions for each:

(a) FACEBOOK

- Enter via the Official Whitby Abbey English Heritage Facebook account: https://www.facebook.com/whitbyabbey/

- Comment on the pinned post ‘Dracula Promo Competition’ and include your photo of you, your friends or family with our 3D Bat Artwork in Whitby. 

(b) TWITTER

- Enter on the on the Official Whitby Abbey English Heritage Twitter Account @WhitbyAbbey

-  Share your photo of you, your friends or family with our 3D Bat artwork in the tweet about the Competition @whitbyabbey 

4.2. Entrants must be over 18

4.3. There is a limit of one entry per social media account. Multiple entries submitted directly or with the use of any automated systems will not be entered into the draw.

4.4. Obscene or inappropriate entries will not be accepted and English Heritage, reserves the right to reject any entries for any reason at its sole discretion.

4.5. Employees or contractors of English Heritage, any person directly or indirectly involved in English Heritage or the running of the competition, or their direct family members are not eligible for the prize.

4.6. By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

5. THE PRIZE

5.1. There are 2 separate prizes available for separate and different entries

a) One prize for a Facebook entry

b) One prize for a Twitter entry

5.2. The prize available to be won will be chosen by the Facebook Competition Winner and the Twitter Competition Winner are either:

(a) 1 x Adult Annual Membership of English Heritage, or;

(b) 1 x Joint Adult Annual Membership of English Heritage, or;

(c) 1x Family Annual Membership of English Heritage.

5.4. Prizes are subject to availability. They are non-transferable, non-refundable and, unless stated, there are no cash alternatives. In the event that the prize is out of stock or if circumstances beyond the Promoter’s control make it necessary to do so, English Heritage reserves the right to substitute another item, in its sole discretion, of equal or higher value.

5.5. Any travel expenses, or any other expenses in the general use of and enjoyment of the prize, that the winners or their guests incur are the sole responsibility of the winners or their guests.

6. WINNER SELECTION & NOTIFICATION

6.1. One winner will be selected at random from all eligible entries received. 

6.2. The Competition Winner will be notified (depending on entry method):

(a) Twitter via the comment section of their competition entry and asked to send us a direct message within 5 days of the closing date.

(b) Facebook via the comment section of their competition entry and asked to send us a direct message within 5 days of the closing date.

6.3. The Competition Winner and asked which category of membership they would like supplied (Adult, Joint or Family).

6.4. If a winner cannot be contacted or does not claim their prize within 24 hours of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

7.  LIMITATION OF LIABILITY

7.1. Insofar as is permitted by law, English Heritage, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of English Heritage, its agents or distributors or that of their employees. Your statutory rights are not affected

8. OWNERSHIP OF PRIZE DRAW ENTRIES AND INTERLLECTUAL PROPERTY RIGHTS 

8.1. English Heritage does not claim any rights of ownership in your competition/prize draw entry.

8.2. This promotion is in no way sponsored, endorsed or administered by, or associated with Twitter or Facebook.

9. DATA AND PUBLICITY

9.1. All personal data provided to English Heritage will be held and processed in accordance with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of personal data and the privacy of electronic communications, including (i) the Data Protection Act 2018 and any successor UK legislation, as well as (ii) the General Data Protection Regulation ((EU) 2016/679) and any other directly applicable European Union regulation relating to data protection and privacy (for so long as and to the extent that the law of the European Union has legal effect in the UK). We will keep your personal data safe and secure. We will not share it with other organisations without your knowledge and consent, unless required by law to do so. We will keep your personal data only for the purposes of communicating with you regarding this competition.

10. GENERAL

10.1. If there is any reason to believe that there has been a breach of these terms and conditions, English Heritage may, at its sole discretion, reserve the right to exclude you from participating in the competition.

10.2. English Heritage reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

10.3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
