TERMS AND CONDITIONS

• 1. The Promoter

  1.1 The promoter is: English Heritage of The Engine House, Fire Fly Avenue, Swindon SN2 2EH.

• 2. The Competition

  2.1 The title of the competition is Members' Week 2022 Competition.

• 3. How to Enter

  3.1 The competition will run from 00:01am on Saturday 23 April 2022 to 11:59pm on Saturday 30 April 2022.
  

  3.2 All entries must be received by the English Heritage by no later than 11:59pm on Saturday 30 April 2022. All entries received after this time are automatically disqualified.

  3.3 To enter the competition:

  enter the competition online by selecting the correct answer and completing the online entry form provided.

  3.4   English Heritage will not accept:

  (a) responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

  (b) proof of posting or transmission as proof of receipt of entry to the prize draw.

  3.5 By submitting an entry, you are agreeing to be bound by these terms and conditions.

  3.6 The competition winners will be selected at random by English Heritage. The decision English Heritage acting reasonably will be final.

• 4. Eligibility

  4.1 The competition is only open to all residents in the UK aged 18 years or over, except: employees or members of their immediate families or households of English Heritage or Sky or their holding or subsidiary companies.

  4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. English Heritage may require you to provide proof that you are eligible to enter.

  4.3 English Heritage will not accept entries that are:

  (a) illegible, have been altered, reconstructed, forged or tampered with; or
  (b) incomplete.

  4.4 There is a limit of one entry per person.

  4.5 English Heritage reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

• 5. The Prize

  5.1 Each day, from 18 April until 24 April inclusive, one English Heritage Member will win a hamper of goodies from the English Heritage online shop when they correctly answer a question featured in the English Heritage Members' E-newsletter. The hamper will consist of the following:

  5.2 One English Heritage Member will win a Sky Glass TV when they have worked out what links each of the daily answers together and filled out an additional competition form. Separate terms and conditions apply for this prize (see item 11 below).

• 6. Winner Announcement

  6.1 English Heritage will contact the winner personally by 8 May 2022, using the email address provided with the entry.

  6.2 The decision of English Heritage is final and no correspondence or discussion will be entered into.

  6.3 English Heritage will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available within 7 days, English Heritage reserves the right to offer the prize to the next eligible entrant selected from the entries that were received before midnight on 30 April 2022.

  6.4 English Heritage does not accept any responsibility if you are not able to take up the prize.

• 7. Limitation of Liability

  7.1 Insofar as is permitted by law, English Heritage, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of English Heritage, its agents or distributors or that of their employees. Your statutory rights are not affected.

• 8. Ownership of Prize Draw Entries and Intellectual Property Rights

  8.1 English Heritage does not claim any rights of ownership in your prize draw entry.

• 9. Data Protection and Publicity

  9.1 By entering the competition, you agree that any personal information provided by you with the prize draw entry may be held and used only by English Heritage or its agents and suppliers to administer the competition.

• 10. General

  10.1 If there is any reason to believe that there has been a breach of these terms and conditions, English Heritage may, at its sole discretion, reserve the right to exclude you from participating in the competition.

  10.2 English Heritage reserves the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so.

  10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

• 11. Sky Terms and Conditions

  
  1. No purchase necessary. The competition will be open from Thursday 21 April until Saturday 30 April 2022. Entry to our competition will be through the online form.

  2. This promotion is open to residents of the UK aged 18 years or over only. Proof of age may be required. The Competition is not open to employees (or family members of employees) of any Sky UK Limited (“Sky”), companies associated with the Promotion and all affiliates of such companies. The Promoter shall allow one entry per household only.
  
  3. A maximum of 1 entry per person over the Promotional Period. Entries sent in through agents, third parties websites or multiple accounts will be disqualified. Entries that contain any sexual, offensive, inappropriate or defamatory content will be disqualified. Late, incomplete or otherwise ineligible entries will also be disqualified. The Promoter reserves the right to not award prizes if qualifying criteria is not met and the right to select replacement entry into the competition element of the promotion.

  4. 1 entrant will be selected at random by an independent person from those enter during the promotional period.

  5. If the winners cannot be contacted within a reasonable time period or are not able or available to accept the prize for any reason which is beyond the Promoter’s reasonable control, then the Promoter reserves the right to award the prize to another entrant

  6. There is 1 prize package to be won (a “Prize”). The Prize includes the following:

  - 1 x Sky Glass TV (55 INCH) with a Sky TV subscription for 12 months to include the following:
  o 1 x Sky Glass TV with a Sky Ultimate TV subscription (consisting of Sky Entertainment and Netflix basic), Sky Sports & Sky Cinema subscriptions and Ultra HD and Dolby Atmos pack subscription included. Prize winner has a choice of 5 x Sky Glass colour finishes, subject to availability.
  o 1 x Customisable speaker fascia. Prize winner has a choice of 5 x colour finishes, subject to availability.
  o 1 x Sky Stream puck with a Whole Home subscription for 12 months
  The Prize will be subject to the Prize Conditions (as defined below)

  7. The following terms shall apply to the Prize (the “Prize Conditions”):

  a. All services on Sky Glass are streamed via broadband, a minimum speed of 35Mbps is required to use the Prize in full.
  b. Only one Sky TV subscription can be provided at an address. If the winner is an existing Sky TV customer and has Sky Q or Sky+, they will need to take a TV subscription for Sky Glass. We will bill the winner for their existing Sky TV subscription until the Sky Glass TV subscription is activation. Sky Q cstuoemsr will need to send back their Sky Q boxes within 60 days of receiving Sky Glass otherwise they may be charged a non returns charge. Third party subscriptions not paid for via Sky but viewed on Sky Q or Sky + will not be viewable on Sky Glass. Recordings on Sky Q or Sky+ will not automatically transfer. If winners have Disney+ or Spotify via Sky, these will not automatically transfer to Sky Glass and winners will need to sign up directly to each via Apps Marketplace on Sky Glass.
  c. For 12 months, the winner will get their Sky TV subscriptions via their Sky Glass TV for no charge. Sky Ultimate TV via Sky Glass is provided on a monthly rolling contract and can be cancelled at anytime on 31 days notice. Ending your Sky Ultimate TV subscription will end your offer period. After your 12 month offer period, all Sky TV subscriptions will become chargeable at their then standard price, unless you change or cancel your package, giv-ing Sky at least 31 days’ notice. Standard subscription prices may change. Please refer to www.sky.com for current pricing.
  d. You must be over 18 and resident in the United Kingdom, Channel Islands or Isle of Mann to win this Prize.
  e. The Prize does not include:
  i. A broadband subscription. All content via Sky Glass is streamed so you must have broadband of at least 35Mpbs to use all the elements of this Prize;
  ii. Sky Box Office, Sky Store purchases/rentals, Stand-alone Premium Channels, or pay-per-view services and events all of which if offered via Sky Glass will be chargeable at the current standard price
  f. Sky Stream puck and the Whole Home subscription will allow you to watch Sky TV on another TV with a compatible HDMI port. This is included as part of the Prize. After 12 months, the Whole Home subscription will be charged at the then standard price unless you cancel it. The Whole Home subscription is provided on a monthly rolling contract and can be cancelled at anytime on 31 days notice. Cancelling your Whole Home subscription will mean your Sky Stream puck will no longer stream any content.
  g. Prices, programmes/channels are subject to change.
  h. If you do not activate Sky Glass within 14 days of receiving Sky Glass, we will automatically activate it for you and your Sky TV subscriptions will start from activation.
  i. Winners must redeem the prize within a year. Winners who are in a current pay-TV contract with either Sky or another provider may defer their Prize for a maximum of 12 months from the date of winning. If a winner does not redeem his/her Prize within 12 months from the date of winning, this could result in loss of the Prize. If the winner has a previous uncleared debt with Sky the winner will not be able to take up the Prize until this debt has been fully cleared.
  j. There is no cash alternative to the Prize or any element thereof and unless agreed otherwise in writing the Prize is non-refundable and non-transferable.
  k. Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inappropriate, offensive or unlawful.
  l. Prize winner will own the Sky Glass TV and Sky Stream Puck. Separate Terms and Conditions apply to Sky Glass and Sky TV subscriptions.
  m. The winner will need to set up a Sky Glass account either online at sky.com or via the MySky app in order to manage their account. Email address required for account login and for Sky to keep in touch about the service.
  n. Sky Glass delivery currently average a 28 day waiting period
  o. Prize winner has a choice of 5 x Sky Glass colour finishes; Ceramic White, Ocean Blue, Racing Green, Dusky Pink and Anthracite. Prize winner will need to confirm colour preference upon acceptance of the prize. Colour stock is subject to availability and may result in a longer waiting period.
  p. Ultra HD and Dolby Atmos pack required to watch Sky content in UHD/HDR and Dolby Atmos. Not all content available in UHD and/or HDR. Content must be optimised to watch in Dolby Atmos.
  q. Netflix basic is included as part of the Sky Ultimate TV subscription and allows viewing in one screen in SD. Netflix terms of use apply.
  r. 55” Sky Glass has an energy efficiency rating of F on a scale of A-G.

  8. Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from the enjoyment of the prize; and/or any postponement, cancellation, delay or changes to the prize beyond the Promoter’s control; and for any act or default of any third party supplier.

  9. By entering the competition, if you are the winner, you agree that you and your guests (if applicable) agree that Sky may make your full names and counties available and may use your full names, counties and photographs for post-event publicity purposes without your permission or paying you anything. You further agree and agree to procure that any guests agree to the use of your names, images and any video or voice recordings of you or your guests (if applicable) in any media in, perpetuity, as Sky sees fit. You agree and agree to procure that your guests agree that the copyright (if any) and all other rights title and interest in and to any contribution by you or your guests shall vest in and be irrevocably assigned to Sky

  10. Sky reserves the right to refuse or withdraw the Prize if a winner or a party authorised by the winner to act on their behalf, threatens or abuses a Staff employee or otherwise conducts themselves in a manner that Sky reasonably regards as inap-propriate, offensive or unlawful.

  11. By entering this promotion and choosing to opt-in to receive more information, you agree that Sky may use your information to contact you about offers, news products and services you may like.   12. Any entrant data collected will be used for the purpose of administering the promotion and contacting the winners to notify them of the prize and, if you are the winner, we may pass them on to third parties to deliver the prize.
