Walmer Castle and Gardens Art Competition 2022- 2023

1. The Promoter is: The English Heritage Trust, incorporated and registered in England and Wales with company number 7447221 and charity number 1140351 whose registered office is at The Engine House, Fire Fly Avenue, Swindon, SN2 2EH (‘English Heritage’).

2. These terms and conditions apply to the Walmer Castle and Gardens Art Competition 2022-2023 (‘the Competition’), running at Walmer Castle from 9am on Monday 13th June 2022 (‘Opening Date’) until midnight on Friday 28th April 2023 ('Closing Date').

3. The Competition is open to all Key Stage 4 and 5 art students residing in the United Kingdom, excluding anyone professionally connected with this Competition. Entrants must have the permission of their parent or legal guardian to enter the Competition.

4. The Winner will receive £100 of art supplies and the Winner’s school will also receive £100 of art supplies. The Winner and the Winner’s school may select the items that they would like up to a value of £100 each and English Heritage will purchase them on their behalf and arrange for the same to be delivered. The two runner-up prize winners will each receive £50 of art supplies that they will select and English Heritage will purchase on their behalf and arrange for delivery.

5. No entry fee or purchase is necessary to enter the Competition.

6. A condition of entry is that entrants must visit Walmer Castle, which they can do for free with their school on a self-led visit. Teachers must book their visit using our online booking portal https://www.english-heritage.org.uk/learn/school-visits/education-bookings/ or by emailing bookeducation@english-heritage.org.uk. We recommend that you visit the gardens at Walmer Castle in September and October 2022 and April 2023.

8. To enter the Competition, entrants must submit their entries directly to Rob Howell at Dover Castle or Walmer Castle by the Closing Date. Entries cannot be delivered electronically. Please ensure full contact details are submitted with each entry.

9. The submitted entry can be of any medium or size. If the entry submitted is a photograph the entry must be printed as the entrant wants it to be seen. The entries submitted must be the original artwork in its final form.

10. Only one entry shall be accepted per entrant and any entries received after the Closing Date are automatically disqualified.

11. Any entry which is obscene, inappropriate, illegible or unintelligible may be disqualified in the sole discretion of English Heritage and English Heritage is not responsible for entries that are damaged, delayed, or lost in transit.

12. English Heritage does not accept responsibility for the return of any entry. If the entrant would like their original entry to be returned, please contact English Heritage on: rob.howell@english-heritage.org.uk.

13. By entering this Competition, the entrant and their parent or legal guardian confirms and warrants that the entrant’s submitted entry:

  • is their own original work;
  • that all copyright, and any other intellectual property rights in the entry are vested in the entrant and they have not assigned, licensed or disposed of or otherwise encumbered any of their rights in the entry;
  • does not infringe the intellectual property rights of any third party, and the entrant and their parent or legal guardian will indemnify English Heritage against any claims made by any third parties in the event of such infringement.

14. Entrants waive their moral rights in the entry, allowing English Heritage to use, copy, modify, adapt and publicly display their entry.

15. All entrants hereby license to English Heritage the use of their entry for display on any English Heritage owned or third-party website or other media for publicity purposes.

16. Entrants’ artwork may be displayed at the Blooming Gardens event in June 2023.

17. The Winners will be selected by a panel of judges appointed by English Heritage and be notified by Friday 26th May 2023.

18. If the Winner cannot be contacted within 5 days of notification, English Heritage reserves the right to withdraw the prize from the Winner and offer the prize to another entrant selected from the entries that were received before the Closing Date.

19. The decision of the judges is final and no correspondence or discussion will be entered into.

20. There is no alternative prize and the prize may not be transferred to another person.

21. By entering the Competition, the entrant and their parent or legal guardian is consenting to the use of the entrant's name and image for publicity purposes on social media channels, websites and in any other media and the parent or legal guardian agrees to accompany the entrant to any publicity events related to the Competition. The parent or legal guardian of shortlisted entrants will be required to complete a Consent Form.

22. By entering the Competition, the School is consenting to the use of the School’s name and image for publicity purposes on social media channels, websites and in any other media and agrees that a member of staff accompanies the entrant to any publicity events related to the Competition.

23. Entry in the Competition signifies the entrant and their parent or legal guardian’s acceptance of these rules. English Heritage reserves the right to withhold or cancel the prize in the event of non-compliance with these rules. English Heritage also reserves the right at its discretion to change the prize and/or amend the Competition rules at any time.

24. English Heritage reserves the right to cancel the Competition at any stage, if deemed necessary in its opinion, and/or if circumstances arise outside of its control.

25. By entering the Competition, entrants and their parent or legal guardian are agreeing that any personal information provided with the entry may be held and used by English Heritage or its agents and suppliers to administer the Competition. All personal data provided to English Heritage will be held and processed in accordance with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of personal data and the privacy of electronic communications, including: (i) the Data Protection Act 2018 and any successor UK legislation; (ii) the UK GDPR; and the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended. We will keep your personal data safe and secure. We will not share it with other organisations without your knowledge and consent, unless required by law to do so. We will keep your personal data only for the purposes of communicating with you regarding this competition. The entrant and their parent or legal guardian shall have the right to withdraw their consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

26. This Competition is in no way sponsored, endorsed or administered by, or associated with Twitter, Facebook, Instagram or any other social network. You are providing your information to English Heritage and not to any other party. The information provided will be used in conjunction with the following Privacy Policy found at https://www.english-heritage.org.uk/about-us/our-people/our-policies/

27. The rules of this Competition shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising out of these terms and conditions.
